P&H High Court: Senior IPS Officer moves to bar DGP from writing appraisal report

A Senior IPS Officer, Y Puran Kumar of rank IGP has approached the Punjab and Haryana High Court seeking directions to the Additional Chief Secretary, Department of Home, to restrain Yadava from writing his annual performance appraisal report and to take immediate decision on his complaints submitted against Yadava.

Y Puran Kumar accused the DGP in regard to his partial attitude, discriminatory treatment and violation of All-India Service Rules, 1968. He also pleaded to refrain from unnecessary communication with Yadava on the Demi Official (DO) letter issued on Aug 17, 2020.

The Petitioner contended that Yadava has been targeting him since the date of his appointment, July 2020, in a ruthless manner and discriminated him on a common issue as he wanted his close aide to be posted in Ambala. 

They further submitted that the issue began on August 3, 2020, when he visited a temple at Shahjadpur Police Station for personal reasons.

The temple had been in existence since 2011, prior to the establishment of the police station, which was built on Panchayat land.

On 17 August 2020, the DGP wrote a DO letter enquiring about the grant of permission to set up temples in the premises of Shahjadpur Police Station. A detailed report was submitted on the letter stating that various temples existed within the police premises without necessary approval from the State Governments and also a special mention regarding the Sirsa temple to be established by then SP Vikas Arora was also made.

The Petitioner further alleged that, “The DGP in a selective and discriminate manner, had only asked for the comments of the petitioner. No action was taken by him when he was informed about the establishment of a temple in Sirsa police station”.

The DGP based on the Petitioner’s reply, issued general directions to all police field units in Haryana that no place of worship or other buildings should be built in the police lines or other police premises. 

The Petitioner submitted that, “Yadava did not stop and issued DO letters dated March 18, 2021 and April 20, 2021 and levelled false and frivolous allegations upon the petitioner and also threatened to initiate disciplinary action for violation of the All-India Services Rules, 1968. The said letters were against the principles of natural justice and had been issued with the sole motive to threaten and pressurize the petitioner for not pursuing the complaints already filed by him”.

In view of the pandemic, Y Puran Kumar’s petition is to be heard as per the new arrangements of restrictive hearing of cases.
