The Madras High Court issued a Non-Bailable warrant against the owners of the companies.

The warrant was issued because the two Chennai based companies imported earthmovers from China 2008 and failed to pay the entry taxes.

The two companies, Grandhe Construction Private Limited and Sri Murugan Earth Movers moved to Court for seeking indemnity from paying entry taxes where Justice S M Subramaniam passed the Interim Order.

The hearing was arranged on August 17 where the counsel for petitioner sought suspension for getting instructions from the petitioner.

After giving several opportunities, the Court finally heard the matter on August 31.

The Court also observed that the issue was earlier settled in the Supreme Court in 2018.

The Advocates who were representing the petitioners informed the Court that although they had communicated about the hearing, there was no response from the petitioner.

The petitioners were only stating that they are not in a condition to pay tax.

While giving the order, Justice Subramaniam stated that “In view of the stand taken by the petitioners and considering the submissions made by counsel for the petitioners, this court is inclined to issue non bailable warrant to the petitioners, returnable on September 6.”
