Kerala High Court upheld Decision of Lakshadweep Administration

The Kerala High Court on Friday dismissed a Public Interest Litigation that challenged the decision of the Lakshadweep Administration to close dairy farms and omit meat from the menu of mid-day meals in Schools on the Lakshadweep Islands.

The Order was issued by a Division Bench of Chief Justice S Manikumar and Justice Shaji P Chaly in response to a Petition opposing the changes implemented by the New Administration.

Standing Counsel for the Lakshadweep Administration, S. Manu, contended that the Court can not intervene in such Policy decisions taken by the Administration.

The Court had already stayed the Implementation of two Orders issued by the Lakshadweep Administration.

The Administration had justified the decisions by stating, “The functioning of dairy farms is resulting in a huge loss amounting to approximately 1 crore every year. Also, the Nutritional needs of the children can easily be satisfied with the altered menu.”

Further, the Administration asserted, “The petitioner merely aims for publicity, thereby implying that the Writ Petition was an abuse of the process of the Court.”

The Court dismissed the Petition after reviewing the Counter-Affidavit filed by Lakshadweep Administration, which supported the Policy decision.
