Kerala HC Issues Directions to Ensure Vehicles Comply with Motor Vehicles Rules

Kerala High Court while, hearing a plea concerning the compliance of Motor Vehicles Rules, issued directions in pursuance to the road safety measures in the State.

The High Court has directed the Transport Commissioner to take necessary steps for implementing strict measures against violating of Motor Vehicles Rules and Court’s directions for road safety.

The Bench headed by Justice Anil K. Narendran ordered the Transport Commissioner to file a report regarding the action taken in implementing the directions issued in an earlier judgement dated 28.10.2019. 

The petitioner, Principal of Sabari PTB Smaraka Higher Secondary School, filed a writ petition seeking approval of use of his class of vehicle as an Educational Institution Bus (Contract Carriage) without any compliance with Rule 125C of the Central Motor Vehicles Rules.

The Bench questioned the petitioner that, the said vehicle has not complied with safety rules of the Motor Vehicles Act and yet it has been granted a fitness certificate by the concerned authorities.

The Court also noted the report of April 5, 2021, where a group of lorries fitted with unauthorised lights, stickers on safety glass and obstructions to the clear vision of the driver had obtained approval from the Motor Vehicles Department. 

The Court issued directions on the use of flashy headlights, no usage of official Emblem or Flags, use of Name Boards, Legible Registration Marks.

The matter will further be heard on July 7, 2021.
