Kerala HC: Without ID Cards, street vendor will not work from December 1

Recently, the Kerala High Court has stated that from December 1, those street vendors who does not have an ID Card will not work in Kochi.

Adding to this, the Court also ordered the Kochi Corporation to implement the necessary steps in order to start the effective implementation of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 for the rehabilitation of street vendors within its limits.

“Effective 01.12.2021, only such street vendors as having obtained the certificates of vending from the Town Vending Committee of the Cochin Corporation shall be permitted to carry on street vending activities within the limits of Cochin Corporation,” ordered Justice A.K Jayasankaran Nambiar.

The Court also took note of the fact that the Corporation already issued identity cards to around 700 eligible street vendors, and was in the process of issuing them to the rest.

From their side, the Kochi Corporation educated the Court that apart from already 876 eligible vendors, an additional 927 have applied for identity cards.

Adding to this, the Corporation stated that out of these 927, 398 were identified to be eligible, and a meeting is scheduled on 19th November to finalize the list.

After listening to this, the Court stipulated that this all process is going to end by 30th November.

Accordingly, the Court ordered, “It is made clear, however, that with effect from 01.12.2021, such persons/applicants shall not be permitted to carry on street vending activities till such time as they obtain the certificate of vending from the Town Vending Committee of the Cochin Corporation.”

Adding to this, the Court also impleaded Suo Motu on the District Collector and the Commissioner of Police as additional Respondents in the matter.At the end, the Court adjourned the matter and listed it on 3rd December for further hearing.
