Kerala HC quashed Order issued by KAT for being Violative

Kerala High Court revoked an order issued by the Kerala Administrative Tribunal (KAT) for extending the validity of the Last Grade Servants (LGS) in the State till 29th September. 

A division bench comprising Justice Alexander Thomas and Justice A. Badharudeen remarked that the extension is unnecessary as the validity of the PSC rank list has been already been extended once.

Earlier, the published rank list of PSC was to expire on 29th June. However, it was extended to 4th August. In a recent order of KAT, it has declared the validation of the rank list for Last Grade Servants shall continue for another month.

After making a notice the Kerala Public Service Commission reached the High Court with filing a plea challenging the extension.

The plea stated that the order of KAT was legally unsound and the extension was illogical and cannot be made accepted as if the order comes into effect, new candidates will not get a chance.

The Court highlighted certain lapse in the KAT’s order, adding to this, the Court said that it was a violation of the earlier orders passed by the Court.

Therefore, the bench revoked the order.
