Karnataka HC issues notice to former CM Yediyurappa for probe in Corruption Case

Karnataka High Court has issued notice on a plea seeking for investigation in the corruption case against the former Chief Minister BS Yediyurappa, his son BJP State Vice-President BY Vijayendra, and their family members, a Former Minister ST Somashekar and an IAS officer.

A single bench headed by Justice Sunil Dutt Yadav issued the notice on the petition filed by a social activist TJ Abraham, sought for a Special Investigation Team probe constituted of senior officers of the Anti-corruption Bureau.

The petitioner approached the High Court after Trial Court dismissed his private complaint, against Yediyurappa and others for corruption allegations. 

The Trial Court noted that “Private complaint filed by the complainant under Sec.200 of Cr.PC, and an interim application filed by the complainant under Sec.156(3) of Cr.PC, are not maintainable in the absence of valid sanction and accordingly dismissed.”

In the High Court, Abraham filed a PIL which was listed before the division bench headed by Chief Justice Abhay Shreeniwas Oka, who opined that the matter is not subject to PIL as the petitioner has his personal interest in it.

Abraham was further directed to file a plea, which was listed recently before the single bench of the High Court headed by Justice Sunil Dutt Yadav.

Abraham, in his plea, has alleged Yediyurappa, his family members, and others had received a bribe on his behalf to a tune of Rs 12 crore concerning the Bangalore Development Authority (BDA) housing project and another illegal collection of around Rs 17.5 crore.

The matter is further listed to be heard on August 17.
