Kerala HC: Erection of Flagpoles in Public Places without permission is Illegal

Justice Devan Ramachandran stated that putting up Illegal Flagpoles and Posts of Political parties in Public places without proper permissions from the competent Authorities is a complete Violation of Law.

While Hearing a Case against putting up Flag masts in Mannam Sugar Mill in Pandalam, Kerala, Justice Devan Ramachandran stated that the culture of putting up Flags and posts of influential political parties has permeated the society deeply and needs to be controlled. 

Flags of Political Parties are being installed widely all over the State. 

The Court stated that such installations can only be done after obtaining permissions from the Local Government Institution or any other competent Authority.

The Court observed that not only were the Flag posts merely installed, the person who did so seemed to think that they were in possession of the land on which flag post was Erected. It was made “Demonstrably clear” in every nook and corner of the State.

Additionally, the Court ordered the State Government to furnish information about all Illegal Flag posts in the State .
