Karnataka High Court dismisses Amazon Flipkart petitions against CII

The High Court of Karnataka dismissed the petition which was filed by US-based Amazon and Walmart-owned Flipkart against the Competition Commission of India (CII).

The petition was challenging the CII probe order against the two companies for alleged anti-competitive practices.

The division bench comprising Justice Satish Chandra Sharma and Justice Nataraj Rangaswamy stated that the petitions by both the companies were devoid of merits and substance.

“Not finding any reason to interfere in the order of the tribunal and therefore the petition is dismissed,” the Judges said further.

While both the companies were denying getting into any investigation, Commerce and Industry Minister Piyush Goyal insisted that companies should allow CCI to investigate if they haven’t done anything wrong and are honest to their business.

Amazon and Flipkart are considered to be India’s biggest e-commerce players.

This was for the second time when the Court had gone against both these companies, earlier they had challenged a Single bench’s order for permitting antitrust bodies to do an investigation against these companies under Section 3 of the Competition Act that deals with anti-competitive agreements.
