The Supreme Court sought response of the Central Government within a week on a plea challenging the order of the Calcutta High Court.

The Calcutta High Court allowed the Central Bureau of Investigation (CBI) to probe a case about illegal mining and transportation of coal through the Railways in West Bengal, particularly without the State’s consent.

A bench of the Apex Court, asked the Solicitor General, Tushar Mehta, to file a detailed report within a week and posted the matter for further hearing for a later date.

They did this after going through the appeal filed by the prime accused who was Anup Majee. The bench of the Apex Court was headed by Justice DY Chandrachud.

In this particular illegal coal mining case, the CBI had interrogated Abhishek Banerjee who is the nephew of the State Chief Minister.

The State government has filed an affidavit and stated that the CBI didn’t have the jurisdiction to probe the case. This is because the State had not consented to the CBI going ahead and investigating. The State government stated in its reply that the same case is being investigated by the CBI.
