The petitioner wanted to conceive a child with her husband who was infected with Covid through the IVF technology. The hospital didn’t allow it and asked her to furnish a court order directing it to collect the sample.
Hence, she approached the Gujarat High Court on Tuesday with an urgent plea, saying that her COVID infected husband was suffering from multi-organ failure and was on a life support system and according to doctors he has fewer chances of survival
The Court directed the hospital to conduct the IVF/ART procedure for the collection of his sample and keep it stored in an appropriate place as per medical advice till further orders.
The Court stated, “The ad-interim relief is granted in an extraordinary urgent situation before the court and the same shall be subject to the outcome of the petition.”
Until further order, the Court has denied permission to proceed with artificial insemination.
