Fatehabad Court orders lower court to take action against NRHM former director in recruitment scam

The Fatehabad Court has ordered the lower court to proceed with the complaint against retired Director General of National Rural Health Mission (NRHM) Dr. Surajbhan Kamboj, accused in an eight-year-old recruitment scam.

Additional Sessions Judge (ASJ) Surender Kumar observed that, “There is sufficient material on record to proceed further with the complaint against the accused for commission of offence punishable under Sections 166 (public servant disobeying law, with intent to cause injury to any person), 167 (public servant framing an incorrect document with intent to cause injury) and 415 (cheating) of the Indian Penal Code.”

ASJ directed the Court of Chief Judicial Magistrate (CJM), to pass a fresh order on the complaint in accordance with the law.

Advocate Vinod Godara of Fatehabad, who was advocating in the Supreme Court regarding the issue filed a petition in the Court of ASJ, under Section 156(3) of the Code of Criminal Procedure (CrPC) for sending it to the SHO concerned for registering an FIR under Sections 166, 167, 415, 418, 463, 464, 466 and 468 of the IPC against Dr Kamboj.

As per the complaint, Dr Kamboj had allegedly committed irregularities in the filling of vacancies in the National Rural Health Mission (NRHM) when he was the Civil Surgeon in Fatehabad in 2013-14.

This matter is related to the recruitment of Data Manager. In this case, Sachin Munjal of Fatehabad had first filed a petition in the High Court regarding the irregularities in the recruitment, whose decision was given in March 2017 while dismissing the petition.

In this, the High Court stated that the Civil Surgeon had committed, in which apart from Sushil Kumar, who was admitted on fake documents, the officers of the department were made party.

The High Court directed the Superintendent of Police (SP) has to conduct an inquiry, but no action was taken.
