Fake Lawyer moves Kerala High Court seeking Anticipatory Bail

Sessy Xavier, who is accused of practising law for two years without having completed her LL.B degree, has moved to the Kerala High Court for Anticipatory Bail.

Xavier had made headlines last week after an anonymous letter accused her of not having enrolled in the State Bar Council or even qualifying LLB.

ShXavier had practised as an Advocate for a period of two years before the courts in Alappuzha.

On enquiring with the Kerala Bar Council, the authorities of the Bar Association were surprised and shocked to note that the enrollment number given by Sessy Xavier belonged to another advocate.

The other advocate was practising at Thiruvananthapuram.

Ironically, Xavier had contested the Bar Association elections this year and was elected as the Librarian.

The situation took a dramatic turn when she went to surrender before the Magistrate in Alappuzha, believing she would be released on bail. However, upon realising that she was charged with non-bailable offences, she fled the courtroom.

On the basis of a complaint filed by Alappuzha Bar Association secretary Abhilash Soman, the Police have registered a case under Sections 417 (cheating) and 419 (cheating by impersonation) of the Indian Penal Court.

The Police claim that she lacked the required qualifications and had presented the association with a fake Kerala Bar Council roll number.

The association’s office-bearers also claimed that she had misplaced rare documents from the library. In this case, the police have also filed a theft complaint against her.
