Delhi High Court: Freedom of Movement should not be restricted due to lack of essential Civic Amenities

The Delhi High Court has noticed that the Constitutional guarantee of citizens that is ‘Freedom of movement’ as provided in the Constitution should not be restricted due to deficiency of civic amenities.

The HC was hearing the Plea that focused on the action of the Authorities for preservation of trees in city’s Vasant Vihar area.

The Court had seeked a response of the South Delhi Municipal Corporation and Delhi Police over concretisation of hundreds of tress after noticing that the Municipal Corporation permitted the insensitive matter for years.

The Court stated, “The Court is assured that the effortrs will continue in right earnest so that public amenities, like clear footpaths, are made available in their fullest, for all users.”

The Advocated representing Delhi Police submitted that all assistance will be provided to SDMC for working out the Court’ orders even for the discarding of encroachments on public places.

The Court also ordered that the photos of each and evry stretch after repaired, restored and made public friendly shall be file displaying before and after situations while also taking the Petitioner’s confidence.

The Court added, “A senior officer of PWD shall coordinate with the Office of the Deputy Commissioner, SDMC, and shall be present at site on all dates when the exercise of removal of encroachments and restoration of trees is undertaken by the respondent. PWD shall also take remedial measures apropos streets maintained by it.”

The High Court further adjourned the matter to November 26 for further hearing for which the Court Ordered that a Compliance Affidavit be filed before next date of hearing.
