Delhi High Court allows Duty-free Import of key drug till waiver decision by Centre

Delhi High Court has allowed duty free import of Amphotericin B, key drug for black fungus treatment, by private individuals and organizations for personal use.

The Court pointed out that since the drug was in short supply, any individual making it possible to import the drug must not be objectionable to the Government.

A bench of Justices Vipin Sanghi and Jasmeet Singh asked the government to decide on the matter of waiving off any duty on the key drug at least till the time drug is in short supply in India.

While observing the seriousness of the issue, the Court directed, “That any drug imported by any individual shall be allowed on a bond furnished by the importer without the actual duty being paid.”
