Delhi HC Grants Temporary Relief to Contractual Employee Association Members for Involvement in Service Regularization Recruitment Process

The Delhi High Court issued a temporary relief order, permitting members of the Delhi State Contractual Employees Association (DSCEA) to participate in the recruitment process for service regularization while the Writ Petition (WP (c) 45671 of 2023) is under consideration.

In its initial assessment, the Court concluded that granting interim relief was necessary to prevent the remedies sought by the petitioners from becoming ineffective.

The DSCEA had filed a series of writ petitions challenging a circular issued by the Deputy Secretary of the HR-Paramedical Branch on August 24, 2023, an advertisement dated July 31, 2023, and an office memorandum from October 11, 2020.

Justice Chandra Dhari Singh stated, “Considering the arguments of both parties and taking into account the facts and intervening circumstances, this Court is of the initial opinion that the matter deserves consideration, and thus, interim relief may be granted to the petitioners to ensure that the remedies they seek remain viable… Consequently, during this interim period, the contractual staff members of the petitioner Association are permitted to participate in the recruitment process, pending the outcome of the writ petition.”

The court stated that the contractual staff members of the Petitioner Association are now allowed to participate in the ongoing recruitment process, with the final outcome depending on the Writ Petition’s resolution.
