In December 2022, the Crime Branch of Delhi Police arrested T. V. Radhakrishnan, former secretary of Nanda, along with other accused persons after a complaint from Nanda alleging that these accused persons had cheated him.
There were grave allegations against the Accused of criminal conspiracy to fraudulently transfer Nanda’s property worth hundreds of crores (including his House in Friends Colony (West), Delhi and shares owned by him.)
The F.I.R. alleged that the accused were part of a big land grabbing mafia having links with crime syndicates such as Chandraswami Gang, Dawood Ibharim and Abu Salem Gang, etc.
Radhakrishnan (Nanda’s former secretary) had previously been denied Bail by the lower courts. However, Justice Amit Bansal of Hon’ble Delhi High Court enlarged Radhakrishnan on Bail, in view of the fact that the investigation qua the applicant was complete and the trial was likely to take time.
Sunil Kumar Singh and Mukti Singh, Advocates for the accused Radhakrishnan placed reliance of the Judgment of the apex court in Sanjay Chandra v. CBI wherein it was held that bail is the general rule, and jail is an exception and that the object of bail is to secure the presence of the accused person during the trial. The object is not to punish the accused person before the trial.
