Delhi HC dismisses Protection Petition filed by LGBTQ Couple Threatened by their families

On Monday, the Delhi High Court dismissed a protection petition brought by an LGBTQ couple fearing threats from their relatives noting that the couple had been relocated to a safe place.

However, a Single-Judge bench of Justice Mukta Gupta stated, “Once there is no threat perception, the petitioners be then shift to their own accommodation.”

This decision came after the Delhi High Court had directed the Police to supply adequate security to the LGBTQ couple, facing threats from their families as a result of their relationship wasn’t approved by their families.

The Court additionally directed that the couple be shifted to a secure house, originated by the Delhi Government.

During the course of the hearing, Advocate Utkarsh Singh showing for the couple submitted before the Court that once facing threats from their relations, the couple had come back to Delhi from Punjab in order to solemnize the marriage.

After hearing the plea, the Court directed the SHO police of the involved police station to make sure that the couple are going to be taken safely from the NGO’s office to a secure house at Sewa Kutir Complex in Kingsway.

The aforementioned safe house is maintained by the Delhi Government for the protection of couples facing threats from their families as per the directions of the Supreme Court in the Shakti Vahini case.

Earlier this year an order was passed by Justice Gupta, granting protection to a lesbian lady who had been married to a person against her desire and was vulnerable to be “cured” of her sexual orientation.
