Delhi HC directs to Provide Court Documents in Braille Script

Single Judge Bench of Justice Anoop Kumar Mendiratta, directed Delhi Government to provide all Documents of the Court in a Braille Script so that the persons who are Visually Impaired can read such Documents.

Court also made it clear that Right to Access Justice also comes with the Right to have all the necessary Documents in such a language which is readable by the parties and in such means of communication understood by parties.

The Court was hearing Appeal on the Anticipatory Bail Application filed by the Accused of rape. The Appellant and the complainant both were Visually Impaired. The Appellant took the complainant in his accommodation.

There he filled her forehead with vermillion and assured her that he will marry her later after this he established physical relation with her.

The Court granted the Bail to Appellant but the Advocate representing the complainant asked the Court to provide Documents in Braille Script so that her client can read and understand it.

Justice observed that in this Case both the parties being visually impaired it is important for them to be aware about all Material Documents and Proceedings as it will going to affect their lives.

As per Section 12 of Rights of Persons with Disabilities Act 2016 (RPWD Act) makes it Mandatory Duty of the State Government to provide differently abled persons with Access to Justice.

Sub-Section of above Section also mandates that all Public Documents should be available in such a format that everyone can have an access of it.

“Further it is mandated to make available all necessary facilities and equipment to facilitate recording of Testimonies, Arguments or Opinion given by persons with disabilities in their preferred language and means of communication. Right to Access to Justice includes the Right to Receive Documents to which the parties are Legally entitled in the language and means of communication decipherable by them,” Court stated in the Order.

The Court asked to make this direction available to all the concerned departments so that people should not face inconvenience.
