A Delhi Sessions Court upheld the Additional Chief Metropolitan Magistrate’s order of framing notice against BJP leaders in a criminal defamation case filed by Environment Minister Imran Hussain.
Accordingly, it dismissed the appeal of BJP leaders Kapil Mishra and Vijender Gupta. Additional Sessions Judge M K Nagpal held-
“It is held that the order dated November 9, 2020, passed by the ACMM (Additional Chief Metropolitan Magistrate) and the notice of accusation dated November 18, 2020, served upon the petitioners by ACMM… are perfectly correct and legal. As a result thereof, both these revision petitions are being dismissed on the ground of maintainability as well as on merits.”
Minister Imran Hussain registered a complaint under sections 499 and 500 of the IPC. The complaint was against three BJP leaders-Kapil Mishra, Vijender Gupta, and Maninder Singh for making false statements against the Minister that he hadreceived Rs 23 crore for compensatory plantation for felling of trees under a colony redevelopment project.
Advocate BS Joon and Mohd Irshad appearing for the Minister stated that the allegations were false.
