Delhi Court Grants Anticipatory Bail to Congress Leader Jagdish Tyler in 1984 Riots Case

The Delhi court provided anticipatory bail to Congress leader Jagdish Tyler in connection with a case related to the Pul Bangash killings during the 1984 anti-Sikh riots.

Special Judge Vikas Dhull granted bail on a personal bond of Rs 1 lakh and one surety of the same amount.

Citing judgments from various high courts and the Supreme Court, the court emphasized that when an accused is chargesheeted without arrest and cooperates during the investigation, there is no need for further arrest.

The court viewed the alleged offense of murder as grave and serious, but it considered the circumstances and concluded that there were no grounds to detain Tyler merely based on the filing of a chargesheet.

The court dismissed the argument that granting anticipatory bail to Tyler would lead to witness tampering or intimidation. It highlighted that witnesses willingly provided their statements before the CBI, demonstrating that they were not threatened or coerced.

Additionally, the court noted that Tyler, despite remaining at large, cooperated with the investigation and joined the proceedings whenever summoned by the Delhi Police/CBI.

Special Judge Vikas Dhull imposed specific conditions on Tyler’s bail, including that he must not tamper with the evidence in the case or leave the country without permission.

The court rejected the notion that granting anticipatory bail would allow Tyler to threaten or intimidate witnesses, emphasizing that there has been no specific allegation against him regarding such behavior.
