Delhi Court Clarifies no Summons Sent to Accused Kerala MLA; Media Persons Submit Apology for Misreporting

A Delhi Court clarified that it has not yet summoned Kerala MLA K.T Jaleel over his Kashmir remarks made on a social media platform two months ago.

The case was dealt by Additional Chief Metropolitan Magistrate Harjeet Singh Jaspal of Rouse Avenue Courts with the complaint filed by Advocate G.S. Mani and stated that the matter hadn’t reached the stage of summoning.

The Court added, “the matter is pending for orders on an application u/s 156 (3) CrPC It is further made clear that till the time the order on the said application is passed, no opinion on merits has been placed on record.” 

Advocate Subhash Chandran K.R., on behalf of Jaleel, informed the Court that he got the information of the proceedings after acknowledging media reports in e-newspapers like the Matrabhumi, Malayalam Manorama and the Malayalam Daily Newspaper.

The counsel submitted that the Newspapers and media portals had reported about the allowance of registration of FIR against K.T Jaleel.

The media persons submitted their apologies and said that they would publish a corrigendum for misreporting.

An Action Taken Report was submitted by the Delhi Police on September 6 stating the submission of a complaint had already been made to the Deputy Commissioner of Police Cyber Cell Unit, Special Cell.

The ATR notified that a Sessions Court in the district of Pathanamithitta, Kerala had ordered the police to register a case against KT Jaleel over the controversial remarks on Jammu and Kashmir and POK, also submitting that the court of Pathanamthitta’s Thriuvalla had issued the directions considering the petition as moved by RSS leader Arun Mohan, seeking legal action against KT Jaleel for his anti-national remarks.

The Court further deferred the matter until the date of 16.09.2022.
