COVID-19 Second Wave: Delhi HC permits issuing notices and summons electronically

Being mindful of the upsurge in Covid-19 cases, the Delhi High Court has allowed service of summons/notices/daks via electronic modes of communication, such as WhatsApp, email and fax.

The circular issued by the High Court reads, “The conventional mode of physical delivery may be restored once the normalcy returns”.

The circular also provides the procedure of furnishing necessary e-mail addresses and other details for the concerned parties.

The circular provides, “The process of sending the documents/summons/daks in electronic mode will continue to be done by the Despatch Branch/process Serving Agency, in co-ordination with respective judicial branches and IT Branch, from their seats only.”

Previously, Justice Rajiv Sahai Endlaw of the Delhi High Court had permitted the plaintiff to serve the summons to one of the defendants via WhatsApp, text message and email.

Around four years ago, the court was hearing the case of Tata Sons alleging that 35 unidentified email IDs were being used to circulate ‘unwarranted, defamatory and baseless allegations questioning the integrity and educational qualification of one of its officials.’

Three internet providers were also made parties to the suit.
