The Complainant stated that he had not been given proper treatment and that his relatives were not allowed to meet with him. He said blood vessels in his injured leg had been removed without his Consent and he was told by doctors that vessels had been transferred to his injured leg.
However, after the Operation, the Applicant had problems and said he was overcharged. and tests. As the leg became infected, the applicant was informed at the Hospital that his leg needed to be Amputated below the knee.
The Applicant then applied to leave the Hospital and was charged 3.25 Lakhs for Treatment and Medication.
Shortly after his Release, the Applicant was admitted to JJ Hospital where he claimed to have received appropriate Treatment.
Annoyed by the way the first Hospital handled his Case, the Applicant fired the Regional Commission.
Prior to the Commission, the Hospital said the Applicant had come to the Hospital himself, and JJ’s Discharge Certificate did not address Medical Negligence.
The responding Hospital further stated that the Applicant owed them approximately 1.10 Lakhs.
After hearing the Submissions, the Commission stated that the Applicant had lost Physical and Financial Loss due to Negligence on the part of the Hospital.
In its Order, the Commission noted that the Applicant is a recognized Attorney and is approximately 60% Disabled due to Hospital Negligence. and a Doctor. The Commission also noted that the Lawyer is the breadwinner for the family.
Therefore, the Commission ordered the Hospital and the Doctors to pay Rs 15 Lakh as Application Damages and 12% interest.
