Chhattisgarh HC asserts Wife Allegations of Husband’s Illicit Relationship with Mother is a Mental Cruelty on husband

The Chhattisgarh High Court has declared that a wife’s repeated accusations of her husband engaging in an inappropriate relationship with his own mother amount to mental cruelty and constitute an assault on the sacred relationship between a mother and her son.

The court highlighted that such allegations not only tarnish the husband’s reputation but also defame the character of his mother.

The bench, consisting of Justice Goutam Bhaduri and Justice Sanjay S. Agrawal, granted the husband’s appeal, overturning the family court’s decision to deny a divorce decree.

The case centered around a couple who tied the knot in May 2011.

The husband contended that his wife’s behavior towards him turned hostile after marriage, as she frequently hurled abusive accusations at him and his mother.

Consequently, the husband sought a divorce decree from the family court, which was initially denied.

Upon meticulous examination of the presented evidence, the court found that the wife had abandoned her husband in December 2013 and had falsely implicated him and his relatives under Section 498-A of the Indian Penal Code. However, all of them were acquitted due to insufficient evidence. Furthermore, the wife admitted in court that she had accused her husband of maintaining inappropriate relations with his mother.

While recognizing the wife’s entitlement to maintenance, the court established a monthly maintenance amount of ₹35,000, which would be deducted at source from the husband’s salary.
