CBSE Class XII: Supreme Court directs School Result Committee to decide Students representation within 2 weeks

Supreme Court directed the School Result Committee to decide the student’s representation within two weeks in relation to a Writ Petition filed by Class 12th passed out students.

The students alleged that the CBSE and Sidana International School had allegedly failed in implementing the evaluation procedure prescribed in the Evaluation Policy dates February 17, 2021.

The Bench comprised of Justices AM Khanwilkar and CT Ravikumar. The Petition had been drawn by Advocate Mamta Sharma through Advocate Ravi Prakash.

Advocate Sharma submitted that the Petitioner’s grievance was that the marks were not awarded as per the policy by the school. She stated,

“We made representation under Type 2 but the school considered it under Type 4. They did not consider the representation raised by the student under Type 2.”

After noting that the Type 2 representation was not decided, the Bench directed the School Result Committee to decide and report back within two weeks.

The Petitioner claimed that the marks were not calculated on the basis of Evaluation Policy dated June 17, 2021 and that the marks had been deducted arbitrarily by the school where the students were awarded less marks which caused prejudice to them.

The Petitioners also sought that the Respondents be directed to provide a detailed scorecard stating the reasons of increasing or decreasing the marks of the students in terms of the Evaluation policy.

It was also sought that directions be issued to CBSE to set up a Committee to investigate the records of the School for finding out the reason behind the variance in the marks awarded.

This matter is listed for hearing on February 18, 2022.
