CBIC Issues Notification Mandating BIS Registration and Random Sampling for Imported Electronic and IT Goods

The Central Board of Indirect Taxes and Customs (CBIC) has formally announced the obligatory requirement for Bureau of Indian Standards (BIS) registration and the implementation of random sampling procedures for imported electronic and IT goods.

The CBIC, after a comprehensive review of various practices related to implementation and process streamlining, has issued specific directives. As part of these directions, Customs Officers are now mandated to verify BIS registration for all cases within the system.

Under the updated procedures, the Risk Management System will randomly select consignments for sampling, with Customs Officers being promptly notified through Examination Instructions.

Samples selected will be forwarded to BIS-recognized laboratories, where testing will be conducted for limited defined non-destructive safety parameters outlined in the relevant IS standards for the product.

These parameters will be identified by the Ministry of Electronics and Information Technology (MeitY) as per evolving requirements. In instances where goods are chosen for sampling, the Out of Charge (OOC) status will only be granted if the sample complies with the standard requirements for the defined parameters, as per the test report furnished by the BIS-recognized labs. Conversely, if the sampled goods fail to meet the standard requirements, the importer will bear the cost of sending the consignments back or their destruction, following extant rules and procedures.

This development is in accordance with Instruction 28/2023 issued by CBIC on December 12, 2023, reflecting the board’s commitment to ensuring the quality and safety compliance of imported electronic and IT goods in the Indian market.
