Bombay HC sets aside Order restraining sale of Autobiography “An Incomplete Life”

The Bombay High Court overturned an Interim Order prohibiting the sale of An Incomplete Life,” the Autobiography of Dr. Vijaypat Singhania, former chairman emeritus of the Raymond Group. 

Years after the octogenarian transferred Rs 1000 crore worth of shares to the latter in the holding company in February 2015, Vijaypat Singhania and his son Gautam, who is the current chairman of Raymond Group, are involved in a heated Dispute.

According to a Division Bench of Justices SJ Kathawalla and Abhay Ahuja, the Single Judge who granted Raymond Relief in a Contempt Case last week was under the “Erroneous Notion” that the Thane court had Injuncted former publisher Penguin from releasing the book in a separate Hearing.

“We do not want to say anything more in view of the following Order,” the Bench added while granting Parties liberty to re-approach the Single Judge.

On November 1, Singhania’s book was released on Amazon, and on November 4, a Single Court issued a Restraining Order against him and two others.

Pan Macmillan Publishing India Pvt Ltd approached the Bench, claiming that the Court had issued an Injunction against Macmillan Publishers India when the book was published.

Raymond filed a Lawsuit in Thane against Singhania and Penguin Random House, the publisher at the time. 

Singhania was Sued for a Permanent Injunction to prevent him from publishing his memoirs. Raymond then filed an appeal in Thane Civil Court when one of its applications was denied, and the Court granted an eight-day extension to the Interim Stay. 

Macmillan argued with the Court that the Injunction was not against them because they were not Parties to the Thane Court Proceedings. Second, the District Court’s order dated April 22, 2019, ceased to exist once the parties had entered their appearance.

After the Bombay High Court’s Division Bench overturned the Order, the case was referred to a single Judge Court, which will Hear it tomorrow.
