Bombay HC restrains distribution of Former Raymond Chief’s Autobiography

On Thursday, a Special Vacation Bench of Bombay High Court stopped the sale and distribution of the Autobiography of Vijaypat Singhania, former Chairperson of Raymond.

The Bombay High Court restrained all the publishers as well as distributors to not sell and distribute the Book named, ‘An Incomplete Life’.

The Court made the order when the Raymond company approached the High Court stating that Vijaypat “surreptitiously” released the Book on October 31.

The company filed a Petition before the High Court in which it claimed that Vijaypat along with the publishers violated an order of Sessions Court in Thane district issued in April 2019, in which the Sessions Court passed an injunction on the release of the autobiography.

“The High Court and the Thane Sessions Court had passed several orders between February 2019 and April 2019 restraining Vijaypat Singhania from publishing or releasing his autobiography,” stated the Petition.

“However, the Respondents (Vijaypat Singhania and publishers) in willful disregard to the orders have already published the book titled ‘An Incomplete Life’ and put it for sale in the market,” added the Petition.

The Plea also stated that there are some confidential things that are mentioned in the book.

“The book is also believed to be containing information and details about the confidential arbitration proceedings and other legal proceedings that are ongoing between the Petitioner’s (Raymond) Chairman Gautam Singhania and Vijaypat Singhania,” stated the Petition. 

Counsels appearing for the company, Kartik Nayar, Rishab Kumar and Krish Kalra, also requested the High Court to stop the publishers, Macmillan Publishers Pvt Ltd, from further distributing, selling or printing the book.

After hearing the issue, a Vacation Bench comprising Justice Tavade passed an order in which he restrained Vijaypat Singhania and the publishers from selling, circulating or distributing the book.

“Persons shall cease and desist from advertising, displaying, writing, editing, printing, authoring, selling, offering for sale, further distribution, or otherwise making available the book directly or indirectly,” stated Justice Tavade.

In April 2019, the Thane Court passed an injunction on the release of the book when Raymond Ltd and its chairman Gautam Singhania approached the Court stating that the contents of the book were Defamatory
