Allahabad High Court: Uttar Pradesh teachers entitled to old pension scheme

The Allahabad High Court has ordered to benefit all the teaching and non-teaching staff members of the Uttar Pradesh Basic Education Department with old pension scheme, provided that the members were appointed before 1 April 2005.

The order comes after various petitions were moved forward in the Court, challenging the order of Special Secretary of the State Government as on 28 March 2005 which implemented the new pension scheme in the Basic Education Department from 1 April 2005.

The Court has ordered that since the petitioners were appointed before the implementation of the scheme, the new scheme will not affect them and they will be paid pension in accordance to the old scheme only.

The petitioners were earlier denied benefits under the old scheme claiming that the institutions were provided grant-in-aid in 2006 and hence they will not be entitled to pension under old scheme.

The Court has directed State Government to complete all the proceedings related to the matter within 4 months.
