The Lucknow Bench of Allahabad High Court comprising Justice Ritu Raj Awasthi and Justice Manish Mathur directed the Yogi Adityanath government to advance its stand in Court on alleged mismanagement in Covid hospitals.

The Bench said, “We direct the Counsel for the opposite parties to seek instructions in the matter”, while declining the submissions of the State Counsel HP Srivastava not to entertain the PIL at Lucknow as Allahabad High Court has already seized the same in a Suo Moto matter.

“Since the government has failed in protecting the life of its citizens for want of effective treatment in hospitals, it is necessary that the Court should intervene in the matter and issue stringent directions to the government authorities to take immediate and effective steps to deal with the situation”, the Petitioner’s lawyer submitted.

The Counsel of Dr VK Singh representing the Petitioner also submitted that the audit of oxygen and supply of medicines in the state was required to be done so that it is properly utilized. He further demanded that a provisional hospital must be established on the new premises in the Court at Gomti Nagar with all facilities to serve the needs of a lawyer, their family members, Judicial Officers and staff.

The Petitioner also demanded the installation of a Pressure Swing Adsorption (PSA) oxygen plant from the PM care fund in Uttar Pradesh to ensure oxygen supply at the earliest.

The Petitioner sought the intervention of the Court, while pointing out the alleged failure of the Government to tackle the situation in an elicit manner regarding non-availability of oxygen for Covid patients, lack of beds in designated hospitals and non-availability of life-saving drugs, among other issues.

The Court has fixed May 18 as the next date of hearing.
