Allahabad HC seeks answers from UP Govt regarding Parole of Murder Convicts

The Allahabad High Court ordered the Chief Secretary of the Uttar Pradesh Government to look into the matter of the release of 4 murder convicts under Covid Parole three times.

The High Court sought answers from the Government while questioning their move of releasing the convicts thrice.

The Allahabad High Court Bench of Justices Vivek Varma and Ramesh Sinha ordered the Government to submit a report pertaining to the circumstances under which the murder convicts, who face a sentence of death and life Imprisonment, were released thrice by the State Government.

The High Court was hearing the matter of 4 Murder convicts who were sentenced to capital Punishment by a Trial Court in 1999. The Uttar Pradesh Government stated that it released the 4 convicts in vide with the order of the Supreme Court.

The March 23rd, 2020 order of the Supreme Court stated that State Governments were to form High-Powered Committees for decongestion of jails by releasing prisoners. In accordance with this order of the Supreme Court, the Uttar Pradesh Government granted parole to convicts who were facing Jail term of up to 7 years.

The 4 convicts were earlier acquitted by the High Court against the decision of a Trial Court. The Supreme Court had however interjected in the matter by setting aside the High Court’s order of acquittal. The High Court later on issued a non-bailable warrant against 4.

In accordance with the current situation, the High Court ordered the Counsel of the convicts to have them surrender before the Chief Judicial Magistrate, Faizabad, failing to which, the Chief Judicial Magistrate would take the convicts under its custody. The matter will further be heard on December 20th, 2021.
