Allahabad HC Imposes Rs 2 Lakh Cost on University for Admission Irregularities

The Allahabad High Court has imposed a hefty cost of Rs. 2 Lakhs on C/M Smt. Vimala Devi Mahavidyalay Bhamai for admitting 60 students to an additional section without completing necessary formalities.

The bench, presided over by Justice Piyush Agrawal, emphasized that the petitioner-institution must deposit the specified sum with the Registrar General of the Court by December 19, 2023.

Additionally, the petitioner is required to submit an affidavit confirming the deposit, along with the receipt, by December 20, 2023. A copy of this order, along with the deposit details, should also be furnished to the District Magistrate, Prayagraj.

Case Background:

The petitioner-institution, affiliated with the State University, had initially received approval to increase the number of seats to 160 (across two sections) by an order dated August 11, 2022.

Subsequently, the institution sought permission for an additional section, resulting in an increase of 60 seats for more students. However, the court noted that the extra seat permitted in the previous order was not duly considered in the subsequent order dated September 19, 2023.

The petitioner claimed to have completed the admission process and fulfilled all fee and formality requirements for students. However, as of the hearing date, no order had been passed, and registration for the 40 students from the additional section was pending.

Court Proceedings:

Upon the case being taken up for hearing, the court was informed that, due to an oversight and a technical glitch, only 20 out of the 60 students in the additional section were allowed to submit fees and complete other formalities.

The Court expressed concern about the remaining 40 students suffering due to the actions or inaction of the respondents. It directed the respondents to permit the remaining 40 students to participate in the upcoming examination, considering the importance of each semester/examination for the students’ future careers.

Imposition of Cost:

While addressing the admission irregularities, the court imposed a cost of Rs. 2 Lakhs on the petitioner. It directed the petitioner to deposit the specified amount by the given date. In case of failure to comply, the District Magistrate, Prayagraj, is authorized to recover the amount.

The case is scheduled to be listed on January 23, 2023.
