All India Judicial Service Deemed Vital for Strengthening Justice Delivery System, Yet Current Lack of Consensus: Law Ministry

In response to inquiries raised by Rajya Sabha MP Rajeev Shukla regarding the government’s intentions to establish an All India Judicial Service, the Law Ministry has clarified that there is presently no consensus among key stakeholders regarding the proposal.

Nevertheless, the ministry’s response emphasized, “From the Government’s perspective, a properly structured All India Judicial Service holds significance in fortifying the overall justice delivery system.”

The reply underscored that such a service would offer an avenue for the inclusion of suitably qualified legal talent through a comprehensive all-India merit selection system.

Furthermore, it highlighted the potential to address concerns of social inclusion by ensuring adequate representation for marginalized and deprived segments of society.

The Law Ministry noted that the proposal had been tabled as an agenda item during the Conference of Chief Ministers and Chief Justices of the High Courts in April 2013.

However, it was concluded that the matter necessitated further deliberation and consideration, prompting the solicitation of views from State Governments and High Courts.

Nevertheless, the response indicates a divergence of opinions among State Governments and High Courts regarding the establishment of the All India Judicial Service.

“While some State Governments and High Courts endorsed the proposal, others expressed opposition to its creation, with some suggesting modifications to the Central Government’s formulated proposal,” the reply articulated.

The ministry also disclosed that the proposal had been featured on the agendas of various conferences, including the Chief Justices Conference (April 2015), Joint Conference of Chief Ministers and Chief Justices of High Courts (April 2015), Parliamentary Consultative Committee meeting (March 2017), and Joint Conference of Chief Ministers and Chief Justices of High Courts (April 2022). However, its inclusion in the conference agendas was hindered.
