Supreme Court: Trend of Lawyers giving Dishonest Advice to their Clients, needs to be Curbed

Justice Chandrachud, while hearing a special leave petition, has condemned the behaviour of lawyers for giving dishonest advice to their clients. 

He stated that this practice of lawyers giving dishonest advice needs to be curbed by imposing costs and other ways.

This observation comes when a special leave petition came in front of the Apex Court after the Division Bench of the Punjab and Haryana High Court approved the decision of a single judge bench which asked the petitioners, who were Central government employees, to use an alternative remedy by approaching the Central Administrative Tribunal.

The Court observed that while the lawyers were continuously giving dishonest advice to their clients by first filing the writ petitions in the High Court, then filing a special leave petition in front of the Supreme Court, the petitioners were in great trouble by this behaviour and were roaming here and there since past 4 years.

The Court stated the settled decision of L. Chandra Kumar Case of calling the writ petition not maintainable wherein an alternative, equally effective remedy is available. 

In conclusion, the Court refused to entertain the writ petition filed, thereby asking the petitioners to approach the Central Administrative Tribunal for appropriate reliefs within two months of the Order.
