Plea filed in Supreme Court to cancel CBSE & ICSE Class XII Exams

A petition has been filed in the Supreme Court seeking directions to cancel the examination of Class XII and devise an objective methodology to declare the results of class XII within a specific timeframe. 

The plea filed by Advocate Mamta Sharma also sought the directions to set aside notification dated 14th, 16th and 19th April with respect to their clause dealing with the postponement of the Class XII examination.

The Notification cancelled the examination of class X and postponed the examination of class XII till further notice.

The petitioner sought the directions passed by the Apex Court similar to the case of Amit Batha and Anr. Vs CBSE and Ors. (2020) which directed the computation and declaration of the result of class XII students on the basis of their previous grades, as their main final examination had been postponed and could not be conducted due to unprecedented situation caused by the pandemic.

The plea stated that the Hon’ble Court took into account the tense situation last year and this year it is even worse. Therefore, the plea seeks the cancellation of the class XII examination and requested that the marking should be done on the basis of the internal assessment. 

The plea reflected that “Conducting Class 12 board examination is not possible because of surging COVID-19 cases. Even online or offline examinations are not feasible because of the unprecedented pandemic. Delay in the declaration of Class 12 results will hamper students taking admission in foreign universities”.

The Plea further apprised that leaving the future of 121 Lakh students on arbitrary and inhuman directions would violate their fundamental right under Article 14 and 21.
