Kerala HC: If Courts dismiss everything on technicality people will lose faith in Judiciary

Kerala High Court on Friday stated that people will start losing faith in the Judicial System of the county if the Courts continue to dismiss everything based on technicalities.

The matter was previously adjourned several times by the Bench comprising Justice PB Suresh Kumar and the Government was strongly criticized by the Bench for arguing on technicalities.

The Court observed that Central Government’s argument on technicalities was termed as a way to delay the Judgment of the case.

The Petition filed by Kitex Garments Limited was regarding administering the second dose of the Covid-19 vaccine to its employees without having to wait for 84 days between the two doses.

The Counsel of the Central government argued that the Petition should not be encouraged as none of the employees of the company have either approached the Court or the Government regarding this matter.

The Court then granted the Government a few weeks notice period to respond to the Petition.

Upon receiving the submissions the Court observed that the Government had previously allowed several people to skip the 84 days waiting period for the second dose of Covid-19 vaccines.

These people include the ones who were travelling abroad for employment or studies and the ones who were attending the Olympics.

The Court also observed that the company have already bought vaccines for all the employees worth 1.5 Crores but due to a delay in a decision by the Government they are not able to administer it.

The Court then stated that if the Government is willing to consider the Petition filed by the Company then the Court can dispose of the matter.
