Kerala High Court allows extension for appointment of KAT Chairman

The Kerala High Court has granted the Cabinet Appointment Committee three weeks’ time to finalise its recommendations for the appointment of the Chairman to the Kerala Administrative Tribunal Advocates Association.

The Division Bench by an interim order dated 1st June 2021 had directed the competent authority to take a decision on the same following a PIL filed by Kerala Administrative Tribunal Ernakulam Advocates Association on 30th April 2021.

In this regard, a subsequent petition has also been filed before this Court seeking appointment to the Tribunal and extending the existing Judicial Members tenure by another term bypassing formal orders. 

Further, the petition also pointed that the competent authority had not taken any action despite the interim order directing them to appoint the Chairman within 3 weeks.

Senior Advocate S. Ramesh Babu opposed the proposition of the ASGI requesting a further four weeks’ time to make recommendations for the said appointment.

The Bench noting that a new Selection Committee had been constituted with Acting Chairman, it observed, “Taking note of the fact that recommendation is actively being considered by the competent authority, it is appropriate to grant three more weeks’ time from today to take a decision in the light of the earlier order passed by us.”

The matter is listed for further consideration of other prayers on 16th July.
