S.M. Kapadia was the 38th Chief Justice of India.

LANDMARK JUDGEMENT-

Lalu Prasad Yadav’s bail cancellation case-

Kapadia was part of a three-judge Supreme Court bench that dismissed a petition filed by two NDA leaders seeking to have the bail of Rashtriya Janata Dal president Lalu Prasad and his wife, former Bihar Chief Minister Rabri Devi, revoked for interfering with the judicial procedure in the disproportionate assets and Income Tax proceedings, accusing both.

Quashing of the appointment of Central Vigilance Commissioner-

The nomination of Chief Vigilance Commissioner P.J. Thomas by the High Power Committee, which included Prime Minister Manmohan Singh, Home Minister P. Chidambaram, and Leader of the Opposition Sushma Swaraj, was quashed by a three-member bench led by Kapadia (dissenting). The decision caused the government much shame and forced Manmohan Singh to admit the mistake in his nomination. Although most political leaders applauded the decision, some experts raised fears about a possible miscarriage of justice.
