Supreme Court slams U.P Govt for Protecting Police Officers

The Supreme Court has pulled up the Uttar Pradesh Government for supporting an extrajudicial killing, and for screening Police Officers who were Accused in an Encounter Death in 2002.

A Bench of Justice Vineet Saran ordered the State Government to deposit Rs. 7 Lakhs as costs within a week. And the said amount will be withdrawn by the Father , Yash Pal Singh.

The Order coincided with Chief Justice of India N.V Ramana’s expressing his strong reservations about the conduct of Police Officers and Bureaucracy in the country.

The Court termed it a ‘Very serious case’ and said,The laxity with which the State has proceeded in the case speaks volumes of how State machinery is defending or protecting its own Police Officers.”

The Incident took place in 2002 in Sikanderabad in Bulandshahr District and the Police shortly after a while filed a closure report in the Death which favored the Police.

The Trial Court however, was not convinced and rejected the closure report in January 2005.

The First Arrest of one of the Accused took place in October 2005, till then none of the Police Officers were arrested for murder for straight nine months.

The Case remained pending for over 10 years without any further Arrest. Successive Orders of the Trail Court in 2018, to stop the salaries of the accused were simply ignored by the Government of Uttar Pradesh.

 Lastly the Apex Court Ordered, “It is noteworthy that it was only after notices were issued by this Court in this Writ Petition on September 2021 that the State Machinery geared up in action and arrested two of the accused person after 19 years and one accused has surrendered.”
