The Supreme Court dismissed a petition demanding to issue notifications to Centre outline “stricter” in order to prohibit any cases pertaining to selling of fake Covid-19 vaccines in the country.
The judges’ bench comprising of Chief Justice S A Bobde and Justices A S Bopanna and V Ramasubramanian said that although it comprehended the “motivation” behind filing of the plea, it cannot pass such general notifications or directives.
“We understand your motivation but you file a concrete case. We cannot pass general directions. We are not the legislature,” the bench stated.
The petition was filed by Vishal Tiwari , his personal capacity.
The court while proceeding in the case via video conferencing asked the Advocate that if he wants to pursue with this issue he shall make a case with solid facts. And with that the court allowed to withdraw with liberty and file afresh. On which the Advocate chose to withdraw his petition which was applied before the distribution of the COVID-19 vaccines.
He had alluded to the statement given by the Secretary General of INTERPOL which stressed upon the fact that certain criminal organizations have been intending to invade or disrupt the stock chains.
The petition also said the INTERPOL official likewise gave an International alert to all legal entities and authorities of the 194 member nations warning them to plan and prepare to combat the coordinated criminal networks targeting on Covid-19 inoculations, wither through web based portals or physical modes.
“Issue writ…directions to the respondent (Centre) to issue strict guidelines and regulations under Disaster Management Act or under any other law by constituting a special committee to prevent the chances of fake and counterfeit Corona vaccine selling/circulating and advertising by any organization, company, online Apps,” it stated.
It had additionally sought for instructions for the public authority offices to run awareness program for security of the citizens against the threat of circulation of such fake Corona Virus immunization.
The court has also directed the respondent i.e. Centre to look into the matter and enact strict law against the criminal act committed by some of selling or circulating forged vaccine be it organization or an individual.
