The Supreme Court of India on Monday barred the Center and the Navy from releasing some officers, including both male and female, who were not given Permanent Commissions.
Seeking reply from the Center, a Bench comprising Justice DY Chandrachud and Justice Surya Kant asked Additional Solicitor General Sanjay Jain and Sr. R Balasubramanian to reconsider the Allegations of a batch of naval officers, some of whom were already removed.
The Bench directed, “Having regard to the fact that some of the officers are due for release on February 2, we direct that the officers who are already in service shall not be released pending further orders of this Court.”
During the hearing, the BAench observed, “Some of them (Naval Officers) are short of pensionable services by a year or two. Those who have been released from service can be considered for pension“. Issuing a notice to the Center and the Navy, the Bench Commission sought its response within four weeks to the batch of petitions filed by the Naval officers, who were not considered for the Pemanent Commission.
Accepting the notice, Mr. Jain said that the matter would be looked into and a detailed counter Affidavit would be filed in due time.
Senior Advocates CU Singh, Huefza Ahmadi, Meenakshi Arora, and others present on behalf of the Navy officers said the vacancies calculated by the Naval authorities were not in line with the Court’s directive in final Judgement in the 2020 Commander Annie Nagaraj case.
