Adani Gas Ltd Directed to Deposit 50% of Penalty Imposed By CCI For Abuse of Dominant Position

Supreme Court Directed Adani Gas Ltd to Deposit Rs 3.20 Crore within four weeks as penalty imposed by the Competition Commission of India (CCI) against Adani Gas Limited for abuse of dominance position.

The Adani Gas Ltd has to deposit 50% of Penalty imposed by CCI within four weeks and remaing Balance is remain stayed. Supreme Court bench comprising Justices D Y Chandrachud, Indu Malhotra and K M Joseph has given this order.

The NCLAT said the conditions “unfair, lopsided, unilateral, harsh and detrimental to the interests of the consumers”. The NCLAT noted that under clause 13 (Billing and Payment) of GSA, the terms and conditions provides that an excess payment by the buyer to the seller due to erroneous billing/ invoicing on the part of seller would give rise to no liability whatsoever on the part of the seller, including interest whereas a delayed payment by the buyer renders him liable to pay interest and there being no corresponding obligation on the part of AGL to pay interest in terms of Clause 13.7.  

Counter affidavit, if any, be filed within a period of eight weeks.

Matter is listed for the month of March 2021 for final disposal.
