SC Reserved Order on Medha Patkar Plea seeking interim release of prisoners in Pandemic

Today Supreme Court Bench comprising CJI SA Bobde along with Justices AS Bopanna and V Ramasubramanian reserved orders on Plea seeking interim release of prisoners from Maharashtra jails on account of the risk of coronavirus spread.

The Supreme Court Bench comprising CJI SA Bobde along with Justices AS Bopanna and V Ramasubramanian while entertaining Plea challenging Bombay High Court’s decision to uphold the Maharashtra State High Powered Committee’s recommendations to not release on emergency parole those prisoners convicted for offences punishable with less than 7 years under Special Acts such as NDPS Act, UAPA, MCOCA etc.

The CJI told the bench would pass a reasoned order wherein the Maharashtra High Power Committee will be at liberty to modify its classification in accordance with the on-ground conditions.

Petitioner Medha Patkar and activist Meera Sadanand Kamath Advocate SB Talekar submitted to court that it was a grave situation where more than 10 prisoners had died.

Chief Justice of India- “We will pass a reasoned order. We will observe that High Powered Committee will be at liberty to change its norms as per changing conditions”
