The Supreme Court closed the suo moto probe taken against the former chief justice of India Ranjan Gogoi that had been registered back in 2019 to examine alleged conspiracy against the Judiciary in 2019.
A three-judge bench of Justice Sanjay Kishan Kaul, Justice A.S Bopanna and Justice V. Ramasubramanian stated that after the passage of two years they have observed that the possibility of electronic record is unlikely and based on that alongside the submission of the three-member sub-committee, the case is closed.
The bench states that the in-house inquiry was set up to look into the allegations against the former CJI’s alleged misbehaviour.The Court noted, “The existence of conspiracy cannot be completely ruled out as Justice Patnaik has not been able to access electronic records. The learned judge has opined in the final paragraph that the report of the Director of Intelligence Bureau says that on account of taking serious decisions in National Register of Citizens (NRC) may have triggered the conspiracy. However, in view of the mandate, the report opines that it cannot really inquire into whether the Chief Justices decision on the judicial side has triggered the conspiracy,”
