Rajasthan High Court: Buses to be seized if found Picking and Dropping Passengers in violation of Motor Vehicles Act

Division Bench of Rajasthan High Court ruled that Buses shall be seized of those Bus Operators who are found Picking and Dropping Passengers in violation of Relevant Rules and Regulations framed under the Motor Vehicles Act and also under the local laws

A Public Interest Litigation (PIL) had been filed in the Court stating that buses were operating from the main road and seriously affecting the movement of the vehicles instead of making use of the operational bus stand at the place donated by the Petitioner. The Petitioner argued that this could give rise to road accidents in the area.

The Respondents were directed by the Court to ensure that no other place than the one marked for the bus-stand is allowed for standing buses and the picking up and dropping of passengers. The Court also directed the Respondents to attend to any complaint made by the Petitioner or any other citizen.

The Court also noted that the Bus-Stand at the place donated by the Petitioner had now been made operational at Shiv in District Baner, according to the compliance report by the Respondents.

It was also noted by the Court that when the bus-stand had not been operational, the public was picking up transport facilities from different places including the busy roads which created traffic problems along the road.

The Bench said, “In the changed circumstances, as the bus-stand at the located place has become operational, we are inclined to dispose of this PIL at this stage.”
