Plea seeking suspension of Congress Party registration over ‘Toolkit’ moved in Supreme Court

A Plea has been filed in the Supreme Court seeking investigations into the ‘Toolkit’ issue, alongside it sought suspension of Congress Party if the party found indulged in anti-national activities.

The plea has been filed by Advocate Shashank Shekhar Jha, it urged the Apex Court to issue direction to the Centre to prepare guidelines against hoarding essential items amidst COVID pandemic.

The respondents in the petition are Indian National Congress, Union Government and Election Commission.

The plea contended that if the charges against the Congress Party for indulging in anti-national acts and playing with lives of people as alleged by BJP are found to be true then it should call for the suspension of the Congress Party’s registration.

The Petition came after the BJP party alleged on 18th May, that a ‘Toolkit’ has been prepared by Congress to tarnish the image of Prime Minister Narendra Modi over handling of Covid-19 situation.

Congress Party on the other hand accused BJP leaders of issuing forged and fabricated letter and averred that it was an attempt to divert the attention of people and to cover their failure over handling the health crisis in the nation.

The plea apprised “Issue a writ, order, or direction in the nature of mandamus or any other direction the respondent no. 2 (Union government) to register a preliminary inquiry pertaining to the alleged Toolkit for the purpose of enquiring whether the Toolkit or any actions pursuant to it, disclose any offence under Section 124-A, 153A and 120B of the Indian Penal Code and Section of the UAPA, 1967, and for the said purpose to secure the custody of the said Toolkit”

Furthermore, it urged the Union Government to issue guidelines to each political party and groups to avoid portraying anti-national stance, which includes showing pictures of dead bodies or crematories, name of the mutants or calling out a particular religion as the reason of spread.
