Plea in Supreme Court seeking liberated collegiums for Appointing members of Election Commission

A Petition was filed before the Supreme Court against the practice of executive appointing the Chief Election Commissioner and Election Commissioners, filed by NGO, Association for Democratic Reforms. This was violating Articles 14 and 324(2) of the Constitution.

The petition contended the Central Govt by not making appropriate law for ensuring fair process for selection of members and that executive alone cannot be a participant in selection of members of poll body.

“To ensure proper implementation of the rule of law, it is in the interest of justice to issue necessary directions/ guidelines to fill the vacuum occurred on account of the aforesaid inaction till such time the legislature steps in to cover the gap or the executive discharges its role”.
