The Apex Court reserved its order on October 15 in a writ petition filed by Activist Chetan Janardhan Kamble seeking probe into the role of the medical staff and U.P. police officials in detroying potent evidence in the Hathras rape and murder case.

The writ petition pointed out that there was manipulation and destruction of evidence because of the involvement of top U.P. police officers and officials of the State Government which evidently indicated that there is a nexus between them and the accused.

It further stated that they are clearly trying to shield the accused.

The Supreme Court Bench headed by CJI S.A. Bobde made an indication to have the Allahabad High Court monitor the CBI investigation being conducted in the matter.

The writ petition further read, “Government hospital at Aligarh had not taken vaginal swabs and body smears of the victim or collected drop sheet after change of clothes, despite finding torn clothes and bleeding on under-garments”.

It is pertinent to note that the U.P. police and other top officials had initially made public statements ruling out the possibility of rape of the victim even before the completion of the primary investigation.

Further, it is a peculiar fact that the body of the victim had been cremated in the dead of the night without informing the family and ignoring their right to bid adieu to her in a respectful manner is clearly intriguing as to whether the police was investigating the crime or burying the evidence to save the accused.
