Delhi HC issued notice over Tablighi Jamaat attendee’s second FIR

The Delhi High Court, issued a notice to the Delhi Government and Ministry of Home Affairs, Government of India after a plea was filed by the foreign national, attending Tablighi Jamaat event. All 11 Indonesian petitioners claimed that they have already pleaded guilty, entered plea-bargains, and have paid the fine imposed of them. They further pleaded, that due to the second FIR lodged against them for the same offense, they are not able to return to their home country. The learned senior counsel, Ms. Rebecca M. John, appearing on behalf of the petitioner, submitted that after adhering to all the requirements, the previous FIR No. 63/2020 has been closed after which the petitioner was preparing to go back to their homeland when current FIR No. 107/2020 and FIR No. 109/2020 were filed against them. Ms. John further stated that all the offenses alleged in the current FIR are the same as those of FIR No. 63/2020. Ms. John further added that the State had not informed the petitioners nor did the petitioner have any knowledge of the same, making it gross abuse of the process of law, from the State’s side.
